Industry Codes Incorporated Into Law Are Fair Use, Judge Says


More than 180 private sector codes and standards that were incorporated into law now fall under fair use, even though they were created by three technical industry associations, a D.C. federal judge ruled.

Of the 217 regulatory standards in question, 184 can be copied and distributed without the permission of the organizations that developed them, Judge Tanya S. Chutkan of the U.S. District Court for the District of Columbia said Thursday.

The ruling ended a nearly decadelong copyright dispute between Public.Resources.Org and three groups that create codes for best practices in a variety subjects, such as materials testing, installation methods …
